Agreement to terms
This website is operated by Karina Rose doing business as Bad Apple Society (“I,” “me,” or “my”), a sole proprietor based in New York, United States. By accessing this site, submitting the contact form, or engaging my services, you (“you” or “the client”) agree to these Terms of Service. If you don’t agree, please don’t use the site or my services.
For project work, a separate written proposal or contract may also apply. If anything in that signed agreement conflicts with these terms, the signed agreement controls.

Services
I offer web design and brand photography services, and a contact/booking form to inquire about them. Specific deliverables, timelines, and pricing are defined per project in your proposal or invoice. I reserve the right to decline or discontinue work, and to refuse service to anyone, at my discretion.

Booking & quotes
Submitting the contact or booking form is an inquiry, not a confirmed booking. A project or session is only confirmed once we’ve agreed on scope in writing and any required deposit has been received. Quotes are valid for the period stated in the quote, or 30 days if none is stated.

Payment
Payments are made through third-party processors such as Stripe or PayPal. Unless your proposal states otherwise:
A non-refundable deposit may be required to reserve your date or begin work;
The remaining balance is due as set out in your invoice or contract;
Final files or final website launch are delivered after full payment is received;
Late payments may pause work and may incur a reasonable late fee where permitted.
You’re responsible for any taxes that apply to your purchase.

Cancellations & refunds
If you cancel a project or session, deposits already paid are non-refundable, as they reserve my time and cover work already begun. Refunds for amounts beyond the deposit, if any, are handled case-by-case based on work completed. Photography sessions may be rescheduled subject to availability if you give reasonable notice (as specified in your booking).

Your responsibilities
To deliver great work, I rely on you to:
Provide accurate information, content, and materials in a timely manner;
Respond to questions and approvals so the project stays on schedule;
Ensure you own or have rights to any text, images, or logos you give me;
Review deliverables and flag issues within any agreed review window.
Delays caused by missing materials or slow responses may affect timelines and cost.

Intellectual property
All content on this website — including text, photography, graphics, and design — is owned by me or my licensors and is protected by copyright and other laws. You may not copy, reproduce, or reuse it without my written permission.
For client projects: upon full payment, you receive the agreed rights to the final delivered work (for example, your finished website or final photographs) as described in your proposal. Unless otherwise agreed in writing, I retain ownership of source files, working files, and any preliminary concepts not selected.

Portfolio & promotion
Unless you ask me in writing not to, I may showcase work I create for you — including website designs and photographs — in my portfolio, on social media, and in marketing materials, with appropriate credit. Just let me know if you’d prefer I keep your project private.

Limitation of liability
To the fullest extent permitted by law, I am not liable for any indirect, incidental, or consequential damages arising from your use of this site or my services. My total liability for any claim relating to a project will not exceed the amount you paid me for that project.

No warranties
This website and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied. While I work hard to deliver quality results, I don’t guarantee specific business outcomes (such as traffic, rankings, sales, or revenue) from any website or photography I provide.

Third-party links & tools
This site may link to or rely on third-party services (such as Showit, Google, Stripe, and PayPal). I’m not responsible for the content, policies, or practices of those third parties. Your use of their services is governed by their own terms.

Governing law
These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law rules. Any dispute relating to these terms or my services will be handled in the state or federal courts located in New York.

Changes to these terms
I may update these terms from time to time. The “Last updated” date above will reflect any changes. Your continued use of the site after changes are posted means you accept the revised terms.
